DAMAGED PACKAGE?

SOME INFORMATION AND A MINI GUIDE ON WHAT TO DO

 

We always take great care in packaging and shipping, but once the goods leave our warehouse, they are no longer under our direct control, and it may happen that the package arrives damaged.

WHY IT MAY HAPPEN THAT THE PACKAGE ARRIVES DAMAGED

There could be several possible explanations: the ordered product is particularly fragile, and the packaging may be inadequate despite the care taken by our specialized staff; some packaging components may have broken during transport for unforeseeable reasons; or the courier responsible for delivery may have inadvertently damaged the packaged goods, for example, during various moves.

WHAT WE DO TO PROTECT YOU FROM THIS EVENT

To minimize the likelihood of product damage, our specialized staff strives daily to securely assemble packages and prepare shipments that are safe for any unexpected eventuality, depending on the item ordered. This is why we never skimp on packaging: in our opinion, it's the only approach that allows us to ensure the highest level of protection, using additional protective layers when necessary for shipping particularly delicate products.

WHAT TO DO IF YOU STILL RECEIVE A DAMAGED PACKAGE

Upon delivery, the courier will always ask you to sign a document (paper or digital) confirming delivery to the address and person indicated when placing the order. Before signing, always take a few moments to check the integrity of the package you received. If you notice anything suspicious (e.g., evidence of impact, even minimal damage, etc.), immediately report it to the courier, indicating that you wish to "accept subject to inspection." This confirms that you have received the goods, while also indicating that something may have gone wrong during transportation or upon delivery. If you see that the package is intact on the outside, but for some reason you suspect the items inside may be damaged, we recommend choosing "accept subject to inspection." This will allow you to check the contents at your leisure, especially since the courier—by law—cannot allow you to open the package before signing.

PLEASE NOTE: Remember that if you choose to collect without reservation, by signing for the package you confirm that it was delivered to you in perfect condition. In the event of any problems, it will be impossible to obtain a refund or compensation.

HOW TO ACCEPT A PACKAGE WITH RESERVATIONS

To accept a delivery with reservations, it's essential to indicate this in the specific fields on the document the courier will ask you to sign upon delivery (the delivery note). Each courier has its own specific procedures, so if in doubt, please ask the delivery person so they can advise you on the correct procedure. Again, we encourage you to always carefully check the external condition of the packaging, verifying that the package is perfectly intact. If the delivery note indicates multiple packages, check that they are all present upon delivery. If damage is evident and you choose to accept the package with reservations, clearly write the reason on the delivery note, for example: "damaged packaging," "missing packages," "broken tape," "holes," etc. If you suspect damage that isn't immediately visible from the outside, remember that you have the right to sign with reservations in any case, verifying any damage as soon as possible and, if so, reporting the anomaly to the courier immediately.

If the courier who delivered the package uses digital tools to record delivery (typically tablets or PDAs), simply write a note (for example, "broken" or "damaged") in the same space used for the signature.

WHAT TO DO IF THE COURIER PROHIBITS YOU FROM SIGNING WITH RESERVATIONS

Sometimes couriers aren't particularly cooperative when you explicitly ask them to sign with reservations, but remember that yours is an inviolable right.

Therefore, if the delivery person ignores your concerns or appears reluctant, and doesn't clearly indicate where to sign to activate the reserve option, speak up or refuse to sign. If they refuse to sign, the courier will be required to return the package to the appropriate branch. You can contact their customer service department, detailing the situation and demanding a clear explanation and a prompt resolution of the issue.

WHAT HAPPENS IF THE PACKAGE IS INSURED AND YOU COLLECT IT WITHOUT RESERVATIONS?

If you choose to sign for an insured package upon delivery without reservation, you immediately lose your right to a refund. The insurance company cannot reimburse you for anything, as you independently and knowingly signed an official document certifying the perfect condition of the package delivered. Therefore, the damage cannot be legally attributed to any mishandling by the carrier.

Pre-contractual information for the consumer - art. 49 of Legislative Decree 206/2005. Before concluding the purchase contract, the CUSTOMER examines the characteristics of the goods, which are illustrated in the individual PRODUCT information sheets at the time of selection by the CUSTOMER. Before concluding the purchase contract and before confirming the order with " obligation to pay ," the CUSTOMER is informed of:

- identity and location of the professional

- total price of the goods including taxes, with details of shipping costs and any other costs

- payment method;

- the deadline by which CELAORCHIDEE.IT undertakes to deliver the goods;

- conditions, terms and procedures for exercising the right of withdrawal;

- information that the CUSTOMER will have to bear the cost of returning the goods in the event of withdrawal;

- existence of the legal guarantee of conformity only for non-perishable goods purchased;

- absence of legal guarantee of conformity for perishable goods purchased;

Conclusion of the Sales Contract

  • These general conditions of sale are an integral and essential part of the sales contract with the customer. The customer's electronic submission of an order implies full knowledge of these General Conditions of Sale and their full acceptance. If the customer does not agree with one or more terms contained in these General Conditions of Sale, he or she is requested to refrain from making purchases on CelaOrchidee.it (the "Site").
  • To purchase one or more products on the Site, the customer must first register on the Site, providing CELAORCHIDEE.IT , in compliance with the applicable provisions regarding the protection of personal data, all the data necessary to allow the latter to execute the orders placed.
  • To conclude your purchase contract with CELAORCHIDEE.IT , the customer must send CELAORCHIDEE.IT his/her order following the procedure indicated on the Site. Sending the order electronically creates the obligation for the customer to pay the price indicated therein.
  • When the customer places an order he will receive an email from CELAORCHIDEE.IT which contains confirmation of receipt of the order and a summary of the same: this email will not, however, constitute automatic acceptance of the order itself.
  • CELAORCHIDEE.IT reserves the right to refuse orders from customers with whom it has an ongoing dispute regarding the payment of a previous order.
  • If you require an electronic invoice, please request it at the time of ordering. A minimum order value of €200.00 applies.

Selling prices

  • All product prices displayed and indicated on the Site are EXCLUDING VAT, which will be calculated during checkout.
  • The cost of shipping and handling, if applicable, will be clearly indicated and displayed before completing the order.
  • Product prices may be subject to change. Customers are responsible for verifying the final sales price before placing their order.

Payments

  • To pay for the products and related shipping and delivery costs, if applicable, the customer may use one of the methods indicated on the order form. Under no circumstances will additional costs be charged for the payment method chosen by the customer.
  • The customer is solely responsible for the data entered and therefore guarantees to use only credit cards that are legitimately available to him.
  • The customer can pay by bank transfer. Instructions will be communicated to the customer during the payment process.

Responsibility

  • CELAORCHIDEE.IT assumes no responsibility for disruptions attributable to force majeure, such as, but not limited to, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that prevent, in whole or in part, the execution of the contract within the agreed timeframe.
  • CELAORCHIDEE.IT will not be liable to any party or third party for damages, losses, or costs incurred as a result of failure to perform the contract for the reasons mentioned above. The customer is only entitled to a refund of the price paid.
  • CELAORCHIDEE.IT is not responsible for any fraudulent or illicit use by third parties of credit cards, checks, or other payment methods when paying for purchased products. At no point during the purchase process does CELAORCHIDEE.IT have access to the customer's credit card number, which is transmitted directly to the banking service provider via a secure connection.
  • Gift cards purchased on our website are valid for 1 year, within which the amount can be spent. After that, the validity expires and the amount will no longer be usable.
  • The essential characteristics of the products are presented on the Site within each product sheet.
  • The photographs on our website are purely indicative. Some photos in the "SHOP" section come from other websites. If anyone recognizes their photo and doesn't want it to appear on this site, please let us know. We'll remove it.

Flowering Plants

  • CELAORCHIDEE.IT reserves the right not to ship flowering plants or plants with buds because they are easily damaged during transport, despite our careful packaging. For any requests for flowering plants or if plants are shipped in these conditions by purchasing them from the section FLOWERED of the site, CELAORCHIDEE.IT is not responsible for the integrity of flowers and buds upon delivery. Complaints and returns in this case will not be accepted. We reserve the right to send non-flowering plants, even if they are marked as blooming, at our discretion, if the flowering stage does not meet our standards.

Customer obligations

  • The data entered during the purchase process must be exclusively your own real personal data and not that of third parties or fictitious. CELAORCHIDEE.IT reserves the right to legally pursue any violation or abuse, in the interest and for the protection of all consumers.
  • The customer indemnifies CELAORCHIDEE.IT disclaims any liability arising from the issuance of incorrect tax documents due to errors in the data provided by the customer, who is solely responsible for their correct entry.

Complaints, returns and refunds

Complaints

  • Upon delivery of the goods, the customer must verify the integrity of the packages and their quantity and quality as indicated in the order confirmation. Even if the packaging is intact, the goods must be inspected within 24 hours of receipt. Any discrepancies in quantity or quality must be reported by telephone or email as soon as possible within 7 days of delivery. Any reports received after this timeframe will not be considered. For all declarations, the customer assumes full responsibility for the information provided.

Returns

  • CELAORCHIDEE.IT reserves the right to replace the product only if it does not conform to the customer's order. Despite our commitment to providing correct taxonomic identification, in the event of errors on the website, we are available, subject to prior written agreement between the parties, to replace the plant in question within 30 days of the customer receiving the product.
  • Given the delicate nature of the product, it is not possible to return plants that comply with the customer's order.
  • Plants always travel at the customer's own risk. We always make every effort to select the most reliable shipping companies and to carefully package the purchased product.
  • The customer may submit a return request for all items on the Site within fourteen (14) days of receiving the products. The products must be returned intact, with the packaging closed (if present), unwashed, undamaged, and with tags, labels, and any other seals that are part of the products; products returned incomplete, ruined, damaged, deteriorated, or soiled will not be refunded.
  • The products to be returned must be delivered to the carrier within fourteen (14) days, starting from when the customer communicated to CELAORCHIDEE.IT of your decision to withdraw from the contract.
  • The costs of returning the materials will be borne by the Customer, including liability in the event of loss or damage to the products.
  • After the products have been returned, the Seller will carry out the necessary checks regarding their conformity to the conditions and terms indicated in this paragraph.

Refunds

  • If the right of withdrawal is exercised according to the methods and terms indicated in this paragraph, CELAORCHIDEE.IT will refund the customer any sums already received for the purchase of the products, excluding shipping costs.
  • Regardless of the payment method used by the customer, the refund is activated by the Seller as quickly as possible and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of the right of withdrawal, after verifying the correct execution of the same and checking the returned products.
  • The Seller will refund using a voucher or gift card.
  • If the payment was made in installments, we will have to wait for the last installment to arrive before we can process the refund.

Size and dimensions

  • Given the nature of the products for sale, sizes will vary from a few centimeters to over a meter, depending on the variety and/or species. "Plants N years old to flowering" refers to young plants that will take approximately N years to flower. "Flowering plants" refers to young plants or divisions of adult plants that have already flowered for the first time or have reached the size of a plant capable of flowering within the year. "Adult plants" refers to good-sized plants that have already flowered several times.
  • Their ability to bloom again over time, however, is not attributable to CELAORCHIDEE.IT , but only to the correct care carried out by the customer.
  • Pot sizes, substrates and media may vary depending on availability.

Applicable law and competent court

  • Any dispute relating to the application, execution, interpretation, or violation of purchase contracts entered into through the CelaOrchidee.it website is subject to Italian law; these general conditions refer, except where expressly provided for therein, to the provisions of the Civil Code and Legislative Decree 205/06 ("Consumer Code").
  • Any dispute between the parties regarding this contract will be under the exclusive jurisdiction of the Court of Pisa.
  • In the event of disputes between the Seller and the customer arising from the General Conditions of Sale, we inform you that the European Commission provides a platform for the alternative extra-judicial resolution of disputes, accessible on the website http://ec.europa.eu/odr .

  • By registering on the site, your data is safe! All data is processed internally in full compliance with privacy laws. It is used exclusively to fulfill your orders or, when you authorize us to do so, to inform you of special offers or promotions related to our products.
