Pre-contractual information for the consumer -­ art. 49 of Legislative Decree 206/2005. Before concluding the purchase contract, the CUSTOMER reviews the characteristics of the goods that are illustrated in the individual PRODUCT sheets at the time of the CUSTOMER's choice. Before the conclusion of the purchase contract and before validating the order with "payment obligation", the CUSTOMER is informed regarding:

‐ identity and address of the professional;

‐ total price of the goods including taxes, with details of shipping costs and any other costs;

‐ payment methods;

‐ the deadline within which CELAORCHIDEE.IT undertakes to deliver the goods;

‐ conditions, terms and procedures for exercising the right of withdrawal;

‐ information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;

‐ existence of the legal guarantee of conformity only for non-perishable goods purchased;

‐ absence of the legal guarantee of conformity for perishable goods purchased;

Conclusion of the Sales Contract

  • These general conditions of sale are an integral and essential part of the sales contract with the customer. The electronic submission of the order by the customer implies full knowledge of these General Conditions of Sale and their full acceptance. If the customer does not agree with one or more terms contained in these General Conditions of Sale, please refrain from making purchases on CelaOrchidee.it (the "Site").
  • To proceed with the purchase of one or more products on the Site, the customer must first register on the Site, providing CELAORCHIDEE.IT, in compliance with the applicable provisions on personal data protection, all the necessary data to allow the latter to execute the placed orders.
  • To conclude their purchase contract with CELAORCHIDEE.IT, the customer must transmit their order to CELAORCHIDEE.IT following the procedure indicated on the Site. The electronic submission of the order gives rise to the customer's obligation to pay the price indicated therein.
  • When the customer places an order, they will receive an email from CELAORCHIDEE.IT containing confirmation of receipt of the order and a summary thereof: however, this email will not constitute automatic acceptance of the order itself.
  • CELAORCHIDEE.IT reserves the right to refuse orders from customers with whom a dispute is ongoing regarding the payment of a previous order.
  • If an electronic invoice is required, please request it at the same time as the order; it is issued for a minimum taxable amount of €200.00.

Sales Prices

  • All sales prices of the products displayed and indicated on the Site EXCLUDE VAT, which will be calculated at checkout.
  • The cost of shipping and transport, if applicable, will be clearly indicated and displayed before the order is finalized.
  • Product prices may be subject to updates. The customer is required to ascertain the final sale price before placing the relative order.

Payments

  • For the payment of the price of the products and the relative shipping and delivery costs, if applicable, the customer can choose one of the methods indicated in the order form. In no case will additional costs be charged in relation to the payment instrument chosen by the customer.
  • The customer is solely responsible for the data entered, therefore they guarantee to use only credit cards of which they have legitimate availability.
  • The customer can proceed with payment by bank transfer. Instructions will be communicated to the customer during the payment process.

Responsibility

  • CELAORCHIDEE.IT assumes no responsibility for inefficiencies attributable to force majeure such as, by way of example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that would prevent, in whole or in part, the execution of the contract within the agreed times.
  • CELAORCHIDEE.IT will not be liable to any party or third party for damages, losses and costs incurred as a result of the non-execution of the contract for the reasons mentioned above, the customer being entitled only to the refund of the price paid.
  • CELAORCHIDEE.IT is not responsible for any fraudulent and illicit use that may be made by third parties of credit cards, checks and other means of payment, at the time of payment for purchased products. CELAORCHIDEE.IT in fact, at no time during the purchase procedure is it able to know the customer's credit card number, which, by opening a protected connection, is transmitted directly to the bank service provider.
  • Gift cards purchasable on our site are valid for 1 year, within which the amount can be spent, after which the validity will expire and the amount will no longer be usable.
  • The essential characteristics of the products are presented on the Site within each product sheet.
  • The photographs on our website are purely indicative. Some photos in the "SHOP" section come from other websites: if anyone recognizes their photo and does not wish to see it on this site, please let us know. We will remove it.

Flowering Plants

  • CELAORCHIDEE.IT reserves the right not to ship flowering plants or plants with buds because these are easily damaged during transport, despite our careful packaging. For any requests for flowering plants or if plants are shipped in these conditions by purchasing them from the FLOWERS section of the site, CELAORCHIDEE.IT is not responsible for the integrity of the flowers and buds at the time of delivery. Complaints and return requests in this case are not accepted. We reserve the right to send non-flowering plants at our discretion even if they are indicated as flowering when the flowering stage is not of a quality consistent with our standards.

Customer Obligations

  • The data entered during the purchase phase must be exclusively their real personal data and not that of third parties, or fictitious data. CELAORCHIDEE.IT reserves the right to legally pursue any violation and abuse, in the interest and for the protection of all consumers.
  • The customer releases CELAORCHIDEE.IT from any responsibility deriving from the issuance of incorrect tax documents due to errors relating to the data provided by the customer, being solely responsible for the correct entry.

Complaints, cancellations, returns and refunds

Complaints

  • Upon delivery of the goods, the customer must verify the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the order confirmation. Even in the presence of intact packaging, the goods must be checked within 24 hours of receipt. Any case of quantitative or qualitative discrepancy must be reported by telephone or electronically as soon as possible within 7 days of delivery. Any report beyond the aforementioned terms will not be taken into consideration. For each declaration, the customer assumes full responsibility for what is declared.

Cancellations or modifications

  • Cancellation or modification of an order is only possible within a short period after purchase, as long as the order has not entered processing. After receiving the order confirmation email that the order is being processed, cancellations or modifications to the order will not be possible.
  • Cancellation or modification of an order with Paypal payment method is never possible as Paypal does not allow it.

Returns

  • CELAORCHIDEE.IT reserves the right to replace the product only if it does not conform to what was ordered by the customer. Despite our commitment to providing correct taxonomic identification, in the case of errors on the website, we are available, subject to a written agreement between the parties, to replace the plant in question within 30 days from the date of receipt of the product by the customer.
  • Given the delicate nature of the product, it is not possible to return plants that conform to the order placed by the customer.
  • Plants always travel at the customer's risk and peril. On our part, there is always the utmost commitment to choosing the most reliable shippers and to carefully packaging the purchased product.
  • However, the customer may submit a return request for all materials on the Site within fourteen (14) days of receiving the products. The products must be returned intact, with the packaging closed when present, unwashed, undamaged and provided with tags, labels and any other seals that are part of the products; products that are returned incomplete, damaged, deteriorated or dirty will not be refunded.
  • Products intended for return must be delivered to the courier within fourteen (14) days, which run from when the customer communicated to CELAORCHIDEE.IT their decision to withdraw from the contract.
  • The costs of returning the materials will be borne by the Customer, including responsibility in case of loss or damage to the products.
  • After returning the products, the Seller will carry out the necessary checks relating to their compliance with the conditions and terms indicated in this paragraph.

Refunds

  • If the right of withdrawal is exercised following the procedures and terms indicated in this paragraph, CELAORCHIDEE.IT will refund the customer any sums already collected for the purchase of the products, with the exception of shipping costs.
  • Whatever payment method used by the customer, the refund is activated by the Seller as quickly as possible and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of the right of withdrawal, subject to verification of the correct execution of the same and verification of the returned products.
  • The Seller will issue the refund using a voucher or gift card.
  • If the payment was made in installments, we will have to wait for the arrival of the last installment before being able to issue the refund.

Dimensions and size

  • Given the nature of the products for sale, dimensions will vary from a few centimeters to over a meter, depending on the varieties and/or species. "Plants N years to flowering" refers to young plants that will take approximately N years to bloom. "Flower strength plants" refers to young plants or divisions of adult plants, which have already bloomed once or have in any case reached the size of a plant capable of blooming within the year. "Adult plants" refers to good-sized plants that have already bloomed multiple times.
  • Their ability to re-bloom over time, however, is not attributable to CELAORCHIDEE.IT, but only to the correct care provided by the customer.
  • Pot sizes, substrates and supports may vary depending on availability.

Applicable law and competent court

  • Any dispute relating to the application, execution, interpretation and violation of purchase contracts stipulated through the CelaOrchidee.it website is subject to Italian law; these general conditions refer, for anything not expressly provided therein, to the rules established by the Civil Code, as well as by Legislative Decree no. 205/06 ("Consumer Code").
  • Any dispute between the parties regarding this contract will be the exclusive jurisdiction of the Court of Pisa.
  • In the event of disputes between the Seller and the customer arising from the General Conditions of Sale, it is hereby informed that the European Commission provides a platform for alternative extra-judicial dispute resolution, accessible on the website http://ec.europa.eu/odr.
